Effective August 7, 1998

1. The artwork purchased here, from Rafael Arrais through KaranBlade is  available to any authorized buyer.

2. YOU EXPRESSLY AGREE that the purchase and use of the artwork is at your SOLE RISK and YOU AGREE that  is WITHOUT WARRANTIES OF ANY KIND BY KARANBLADE, AND ITS AFFILIATES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

3. Buyer is responsible for all charges associated with shipping the artwork.

4. Member certifies to KaranBlade that he/she is not a minor. 

5. Charges/Payment.

(a) This Agreement applies to all artwork, no artwork may be transferred without prior written approval from KaranBlade and is subject to any limits established by KaranBlade, exempting only artwork for which you pay for full ownership.

(b) Buyer agrees that payment must be received before any artwork changes hands.  Payment may be made by either credit card, check (only brazilian citzens can pay with check) or money order.  UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL KARANBLADE, OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THE ARTWORK BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE shipping of artwork to the buyer.

6. Upon request of KaranBlade, buyer agrees to defend, indemnify and hold harmless KaranBlade, from any claims and expenses, including reasonable attorneys fees, arising out of or relating to buyer's purchase of artwork.

7. This Agreement constitutes the entire agreement between you and KaranBlade with respect to artwork purchased and supersedes all prior agreements between you and KaranBlade.  KaranBlade's failure to enforce any provision of this agreement shall not be construed as a waiver of any provision or right. In the event that a portion of this Agreement is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect.
